THREE:The Ministerial changes consequent on the death of Mr. Canning were announced on the 17th of August. Viscount Goderich, afterwards Earl of[261] Ripon, became the First Lord of the Treasury, the Duke of Portland President of the Council, Mr. Herries Chancellor of the Exchequer, Mr. Huskisson Colonial Secretary, and Mr. C. Grant President of the Board of Trade. On the 22nd the Duke of Wellington was gazetted as Commander-in-Chief. He accepted this office at the earnest request of the king, and it was universally felt that he was the fittest man for the post; but those who, with Lord Eldon, earnestly wished for the speedy downfall of the new Ministrywhich they regarded as almost exclusively Canningitelamented that he should have assumed that position which would necessarily paralyse his opposition in the House of Lords, and so far tend to keep in the Administration. There was, however, little chance of that, for perhaps no Cabinet was ever more divided. They intrigued man against man, section against section; and at last, without any external pressure, the Cabinet fell to pieces from its own weakness. Lord Goderich lost heart, and gave in his resignation before Parliament met. The king was at Windsor while the work of dissolution was going on. When it was complete, he said, "If they had not dissolved themselves by their own acts, I should have remained faithful to them to the last." They appeared before him on the 8th of January, 1828, to resign the offices which they had received from his hands. The Duke of Wellington was then sent for. It was not his wish to become Prime Minister of England. The reasons which had impelled him, on a former occasion, to resist the solicitations of his colleagues induced him now to remonstrate respectfully with the Sovereign; but the king would take no denial.

THREE:When the rumours of Mr. Drummond having been mistaken for Sir Robert Peel were spread abroad, it was impossible for zealous Conservatives to forget these things. If the assassin M'Naughten was mad, he was certainly mad about politics; one of the first utterances of his insane ravings when captured having been directed against the Tories of Glasgow. One witness, indeed, swore that on his being asked if he knew the gentleman shot at, M'Naughten replied, "It is Sir Robert Peel, is it not?" The Minister's life was not considered safe, and for some time two policemen in plain clothes followed him about in the street wherever he went. On the 17th of February, the fifth night of a debate in the Commons on the distress of the country, Mr. Cobden rose to speak, and in the course of his address alluded to an attempt made to identify the members of the Anti-Corn-Law League with a most odious, a most horrible transaction which had lately occurred; but in the conclusion of his speech, he said, "I tell the right honourable gentleman [Sir Robert Peel] that I, for one, care nothing for Whigs or Tories. I have said that I never will help to bring back the Whigs, but I tell him that the whole responsibility of the lamentable and dangerous state of the country rests with him." No outcry at these words, even among the Ministerial party, evinced that the House regarded them as overstepping the proper limits of debate. Loud cries for Mr. Bankes, the Dorsetshire landowner, who had been attacked in Mr. Cobden's speech, were the only party sounds uttered, but the Prime Minister was immediately seen to rise. It has been stated that he was "ill and harassed with public anxieties." He was certainly deeply moved by the loss of his valued and confidential friend, Mr. Drummond. His countenance, it is said, indicated extreme agitation, while by gesticulating, and violently striking an empty box before him, he succeeded[507] in obtaining the ear of the House. It was then that his audience perceived that the Minister regarded Mr. Cobden as pointing him out for the hand of the assassin.In the Commons, Mr. Spencer Compton, the Ministerial nominee, was elected Speaker. The king opened his first Parliament in person, but, being unable to speak English, he handed his speech to Lord Chancellor Cowper to read. In the Commons the Address condemned in strong language the shameful peace which had been made after a war carried on at such vast expense, and attended with such unparalleled successes; but expressed a hope that, as this dishonour could not with justice be imputed to the nation, through his Majesty's wisdom and the faithful endeavours of the Commons the reputation of the kingdom might in due time be vindicated and restored. This was the first announcement of the Ministers' intention to call their predecessors to account, and Secretary Stanhope, in the course of the debate, confirmed it, observing that it had been industriously circulated that the present Ministers never designed to bring the late Ministers to trial, but only to pass a general censure on them; but he assured the House that, though active efforts had been used to prevent[27] a discovery of the late treasonable proceedings, by conveying away papers from the Secretaries' offices, yet Government had sufficient evidence to enable them to bring to justice the most corrupt Ministry that ever sat at the helm. Before three weeks were over a secret committee was appointed to consider the Treaty of Utrecht.

THREE:Meanwhile, the publication of Burke's "Reflections on the French Revolution" had caused an immense sensation. It went through edition after edition, and elicited a warm and wide response in hearts already convinced of, or beginning to see, the real tendency of the French outbreak. On[383] the other hand, it greatly exasperated the ultra-admirers of French republicanism, and produced a number of vindications of it by men who, for the most part, were exceedingly bitter against Burke, and denounced him as an apostate, a renegade, and a traitor to liberty. Amongst the most conspicuous of those who took the field against Burke in books were Sir James Mackintosh, Thomas Paine, Dr. Price, and Dr. Priestley, the two latter of whom also made free use of the pulpit for the propagation of their political ideas. Ladies also distinguished themselves in this contest, such as Mary Wollstonecraft, and Mrs. Macaulay, the historian.

THREE:Whilst these changes had been passing at home, the effervescence in America had grown most riotous and alarming. Boston took the lead in tumultuous fury. In August, the house of Mr. Oliver, the newly appointed stamp-distributor, was attacked and ransacked; his effigy was hanged on a tree, thenceforward honoured by the name of the Liberty Tree. It was then taken down, paraded about the streets, and committed to the flames. The colonel of the militia was applied to, but sent an evasive answer, showing that there were others above the mob who enjoyed what the mob were doing. With this encouragement they broke out afresh, crying, "Liberty and Property!" which, said a colonial authority, "was their cry when they meant to plunder and pull down a house." This time they gutted and partly demolished the houses of the registrar-deputy of the Admiralty, the comptroller of the customs, and the lieutenant-governor, destroying a great quantity of important papers. In New York, delegates assembled from nine different colonial Assemblies. The governor forbade them to gather, declaring their meetings unprecedented and unlawful, but he took no active measures to prevent their deliberations. The Congress met in October, and sat for three weeks. They appointed Mr. Timothy Ruggles, from Massachusetts, their chairman, and passed fourteen resolutions denying the right of the mother country to tax them without their own consent; and they drew up petitions to the king and Parliament. Everywhere associations were established to resist the importation of British manufactures after the 1st of January next,[188] and it was agreed that they should dissolve themselves as soon as the stamp tax was abolished. But it is well known, from letters addressed to Franklin, that the Republican element was already widely spread through the colonies, and this very first opportunity was seized on by its advocates to encourage the idea of throwing off the allegiance to England without further delay.The Act of 1712 restored lay patronage, and then the strife began, but not between the people and the lay pastors, but between the clergy and the lay patrons. There grew up two parties in the General Assembly, styled the moderates, and the more advanced, or popular party. The moderates were those who were ready to concede to the demands of Government and lay patronage under a gentle protest; the more popular party, as it was called, was for transferring the right of presentation to the presbytery. The Act of William III., in 1690, gave the original and exclusive nomination to the heritors, land-owners, and elders. The person nominated was to be proposed to the congregation, who might approve or disapprove. But to what did this right amount? The congregation could not absolutely reject; and if they disapproved, the right passed on to the presbytery, whose decision was final. By this arrangement, either the landowners and elders remained the presenters,[168] or, after a vain show of conferring the choice upon the people, the appointment fell to the clergy, or presbytery. From 1690 to 1712, Sir Henry Moncrieff says, "there does not appear the least vestige of a doctrine, so much contended for at a later period, of a divine right in the people individually or collectively, to elect the parish minister." This opinion was fully maintained by the law of William III., in 1690, and confirmed by that of Anne, in 1712. Sir Henry Moncrieff, in confirmation of this doctrine that the people never had a right to elect their ministers in the Scottish Church, quotes the "First Book of Discipline," of 1567, which placed the election of pastors in the people at large; but this error, he says, was rectified by the "Second Book of Discipline," in 1581. By this book the congregation could only consentthe presbyters must finally determine. This contains the law of the Church of Scotland, and the great schism which took place in the Scottish Church, in 1843known as the Disruptionarose merely from the resistance to lay patronage, but with the intention of transferring that patronage to the clergy, not the people.
